Terms of Service

These terms govern use of the Empress API, dashboard, and website, operated by Empress Ecosystems LLC, a New Jersey company. By using Empress you agree to them. Swapp (swapp.eco) is a product of Empress Ecosystems LLC, not a separate entity; Swapp's own terms govern that surface under this same company.

  1. Beta service. Empress is in private beta. Features may change and access is provisioned at our discretion. We aim for reliability but make no uptime guarantee and offer no SLA yet; when that changes, these terms and the Support page will say so.
  2. Use is measured. Empress is a behavioral measurement service: interaction with the platform and with products we operate (including Swapp) is recorded as detailed xAPI event streams as core functionality — this is the product, not incidental analytics. See the Privacy Policy.
  3. Age. You must be 13 or older to create an account or use the service. We do not knowingly collect data from children under 13; if you believe a child under 13 has used the service, contact [email protected].
  4. Your account and keys. You're responsible for keeping API keys secret and for activity under them. Keys are revocable immediately if compromised. Report unauthorized use to [email protected].
  5. Acceptable use. Send only data you have the right to send. Don't store unlawful content, send another party's personal data without a lawful basis, reverse-engineer or overload the platform, or breach others' rights. Put opaque identifiers — not emails or government IDs — in statements.
  6. Your data and ownership. You retain ownership of the statement data you send, and grant us the limited rights needed to store, process, and serve it back to you. We claim no ownership and don't sell it. You can export it in full at any time.
  7. Quotas. Finite tiers enforce a monthly statement quota; exceeding it returns HTTP 429 without dropping data silently. Reads and exports keep working.
  8. Warranty. The service is provided "as is" and "as available", without warranties to the extent permitted by law.
  9. Limitation of liability. To the maximum extent permitted by New Jersey law, Empress Ecosystems LLC is not liable for indirect or consequential damages; total liability is limited to amounts you paid us in the prior 12 months (or, during free beta, US$100).
  10. Termination. Either party may terminate. On termination we provide a final export window, then disable access. Sections on ownership, warranty, and liability survive.
  11. Governing law. These terms are governed by the laws of the State of New Jersey, USA, and disputes are subject to its courts.
